However, I am on trial with 38 aggravated life sentences and nearly 10 thousand years in prison. I would like to ask Mr. Davutoğlu, is your heart not cold, how long do I have to be judged? While there is not a single report about what you did when you were Prime Minister, I have been on trial for so many years because I, as the leader of the opposition, criticize you to control you with the authority given by the Constitution. I want the court to issue a notification to Davutoğlu to come to the next hearing. If the conditions are right, I would like to be present in court.” said.

The trial of Selahattin Demirtaş at the Küçükçekmece 23rd Criminal Court of First Instance with a prison sentence of 1 year to 2 years and 4 months on charges of “publicly insulting a public official” regarding his remarks towards former Prime Minister Davutoğlu continued. Demirtaş attended the hearing with the Audio and Visual Information System (SEGBİS).

Demirtaş’s lawyers were present in the courtroom. The lawyer of Future Party Chairman and former Prime Minister Ahmet Davutoğlu, who were victims in the case file, did not attend the hearing by presenting a petition of apology. HDP MPs Ali Kenanoğlu and Dilşad Cambaz also attended as spectators.

“I WANT TO ASK MR. DAVUTOĞLU, IF YOUR HEART IS NOT SO COLD, HOW LONG DO I HAVE TO BE JUDGED”

Speaking at the hearing through SEGBİS, Selahattin Demirtaş first asked whether Ahmet Davutoğlu’s complaint against him continued. When Demirtaş’s lawyers stated that the complaint was continuing, Demirtaş continued his words as follows:

Mr. Davutoğlu is currently the leader of the opposition party. I want to know what he is complaining about. I would like to listen to the next session. As the leader of the opposition, he has statements on freedom of expression. During his term as Prime Minister, Mr. Davutoğlu withdrew his complaint from all defamation cases against him. I’m the only person he hasn’t complained about. I am surprised, I want to see Davutoğlu in the next session, I want to hear from him what the accusation is. 144 investigations were opened against me, 47 of them turned into lawsuits. According to the European Court of Human Rights (ECHR), I am also a political prisoner. I have been sentenced to a total of 9 years in prison so far. I have been imprisoned for 6 years. However, I am on trial with 38 aggravated life sentences and nearly 10 thousand years in prison. I would like to ask Mr. Davutoğlu, is your heart not cold, how long do I have to be judged? DEMİRTAŞ’S LAWYER EPÖZDEMİR REQUESTS THAT THE CASE BE AFFIRMED

Demirtaş’s lawyer, Ferat Epözdemir, said the following in his defense in court:

My client committed criminal acts while he was the leader of the opposition party and a deputy. The Court of Cassation Chief Public Prosecutor’s Office requested an annulment for the verdict given in the case file in which the client was tried before the Bakırköy Criminal Court of First Instance. As it can be seen, it was stated there that it was stated to investigate whether the words of the client during his time as a deputy would be considered within the scope of legislative irresponsibility pursuant to Article 83/1 of the Constitution. In addition, by specifying the numbers of the files carried out by different courts for the same victim, we request that the legal responsibility of the client regarding the alleged actions be investigated. His file at the Istanbul 47th Criminal Court of First Instance regarding the client’s similar statements towards the complainant is pending. Again, his case at the Mersin 14th Criminal Court of First Instance is at the stage of appeal. We request to be asked about the fate of these files. We demand a dismissal decision in this case file.

HEALING DELAYED

Announcing its interim decision, the court decided to request and examine the files in Mersin and Istanbul Courthouses, which the lawyers wanted to be examined by the court.

The court decided that the other requests of the lawyers would be evaluated at a later stage. The hearing was adjourned to November 4, 2022, at 14:00.
