Constitutional Court decision in the Official Gazette: Will the penalties imposed during the pandemic be returned? – Last Minute Economy News

The text of the decision of the objection made to the Constitutional Court regarding the penalties imposed during the Corona virus pandemic period has been published in the Official Gazette.

In the decision of the Constitutional Court, “…administrative fines collected are not refundable.” It was stated that the phrase was unconstitutional and it was decided to be annulled.

Thus, the way to withdraw the administrative fines regarding the obligation to wear masks and other prohibitions paid during the pandemic was opened.

In the decision, the administrative fines collected in the second sentence of the temporary article 4 of the “Constitutional Court dated 3/11/2022 and numbered 7420 in the Income Tax Law and the Law on the Amendment of Some Laws and Decree Laws” are not refundable. It was decided by a majority of the votes that the phrase “” is unconstitutional and its ANNOUNCEMENT was taken.”

PENALTY CANCELED

At the end of last year, the collection general communiqués prepared by the Ministry of Treasury and Finance Revenue Administration entered into force after being published in the Official Gazette.

According to the collection communiqué, the fines imposed between 11 March 2020 and 9 November 2022 due to non-compliance with the measures taken to prevent the spread of the epidemic, especially the mask, were deleted.

Accordingly, it was decided not to refund the fine payments made before November 9, 2022.
